When a conflict arises between two parties, the first recourse is usually a direct discussion between the parties, in search of a compromise. If a compromise cannot be reached privately, that is usually when lawyers get involved. The legal system’s traditional tool for dispute resolution — litigation — can be time-consuming, expensive and stressful. In recent years, an alternative method of dispute resolution called mediation has been growing in popularity.

  • In facilitative mediation, the mediator serves primarily as a facilitator, carrying communications between each party’s attorney. In this role, she offers relatively little input but creates a buffer between parties that can help calm tensions and lead to compromise.
  • In evaluative mediation, the mediator draws on her experience and knowledge and offers advice. In this more active role, the mediator helps steer both parties and their attorneys toward potential solutions that may be acceptable to both parties.

Mediation can be used to resolve any legal dispute, but one of the most popular ways it is applied is in contested divorce cases. Divorce mediation is a useful tool because divorce often comes with a complicated set of emotions that make it hard to productively negotiate using more traditional methods.
